Not many people like to read the fine print, and our governing documents are no exception. Every home buyer who chooses to live in our community gets a copy of these at closing, if not before: Articles of Incorporation, Bylaws, and Declaration of Covenants, Conditions & Restrictions. They are also available here on our website. Twenty-five years ago, though, there was a different vision for our community, and times change on their own, and now it's time to update these documents to reflect best practices, remove obsolete sections, align them with changes in state and federal law.
In addition to its own thoughts about amending these documents, the Board has received input from two specific groups: one was current and former Board members and committee representatives. The other was comprised of at least two residents from each village, plus others who expressed interest, to provide insights for the Board as to what a modern vision of our community could look like. Then a draft was sent to our attorney, with comments and questions about the initial points of interest. Based on his responses, a second draft was reviewed, more questions were asked, and more suggestions were discussed. Simultaneously, a title search was requested to make sure we had all the easements, annexations, and other versions related to the Articles, Bylaws, and Declaration. The Board then approved a first draft for distribution to the homeowners to get input on several items before a final proposal is made and put to a vote at our annual meeting in December.
While the documents are still undergoing some minor revisions, a summary of each change and the reason for the change has been prepared. Two Town Hall meetings have been scheduled to introduce and explain these three primary governing documents and get feedback for the Board. These are Wednesday, Oct 2, at 7:00 pm, and Tuesday, Oct 15, at 10:00 a.m., plus both of these will be available live on Zoom. The Board will be making its final decisions within the next month, with the goal of providing all the proposed amendments along with the official notice of the annual meeting in December.
